Unfortunately, what many fathers fail to realize in Florida is that if they have had a child out of wedlock, they have no rights to see that child without obtaining a court order, however, they are obligated to pay child support even if they do not have any time-sharing with the child.
This usually results in a great deal of frustration for these fathers and when they come to our firm for assistance, they are frustrated further by the fact that it takes us a little while to get them time-sharing with their child. The law has certain safe-guards in place to ensure that these fathers can have time-sharing with their children, however, the appropriate steps need to be taken before their rights can be established and enforced.
Therefore, in the spirit of Father’s Day, we would like to propose that the perfect Father’s Day gift would be a Parenting Plan. If you have had a child with a man outside of wedlock and you want to take all steps available to you to enable your child to continue to spend time with his/her father, then a Parenting Plan would be the ultimate way to show love and respect for the relationship between father and child.
If you are interested in knowing more about what a parenting plan is, then please feel free to contact our office to schedule an appointment with one of our attorneys to discuss this further.
